Albany Man Indicted for Handgun, Illegal Magazine and Drugs

Albany County District Attorney Lee C. Kindlon announced today that a 22-year-old Albany man has been formally charged for possessing an illegal firearm, an ammunition feeding device and drugs.

Marshall Gause was arraigned on a four-count indictment in front of the Honorable Andra Ackerman charging him with Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree, and Criminal Possession of a Controlled Substance in the Fourth Degree.

On the morning of Aug. 6, members of the Albany Police Department, with the assistance of the New York State Police and the Watervliet Police Department, executed a search warrant at a residence on First Avenue in Watervliet. Gause allegedly tossed a bag out a window when police entered the apartment, and police later found that it contained a loaded handgun and an extended magazine with 29 rounds. A quantity of cocaine was also found.

Gause pleaded not guilty and was remanded to the custody of the Albany County Correctional Facility. Bail was set at $50,000 cash, $100,000 bond, or $150,000 partially secured bond.

Assistant District Attorney Ryan Carty of the Major Crimes Bureau is prosecuting the case.

ALL DEFENDANTS ARE PRESUMED INNOCENT UNTIL PROVEN OTHERWISE.
