Watervliet Man Pleads Guilty to Possessing Illegal Handgun and Drugs

Albany County District Attorney Lee C. Kindlon announced today that a 22-year-old Watervliet man has admitted to possessing an illegal firearm, an extended magazine and cocaine.

Marshall Gause pleaded guilty in front of the Honorable Andra Ackerman Tuesday to Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree and Criminal Possession of a Controlled Substance in the Fourth Degree.

On the morning of Aug. 6, members of the Albany Police Department, with the assistance of the New York State Police and the Watervliet Police Department, executed a search warrant at a residence on First Avenue in Watervliet. Gause tossed a bag out a window when police entered the apartment, and police later found that it contained a loaded handgun, an extended magazine with 29 rounds and 11 grams of cocaine.

Ackerman ordered Gause to wear an electronic monitor and to remain in house confinement until he is sentenced on Dec. 18 to seven years in state prison.

Assistant District Attorney Ryan Carty of the Major Crimes Bureau is prosecuting the case.
