Albany County District Attorney Lee C. Kindlon announced today that a 28-year-old has been convicted in a jury trial of raping a 14-year-old girl.
Mohammed Gubari was found guilty on Friday afternoon of Rape in the First Degree and Rape in the Second Degree after a three-day trial in front of the Honorable Thomas Marcelle.
Assistant District Attorneys Alizabeth Volkman and Stacy Mix of the Special Victims Unit prosecuted the case with the aid of trial assistant Mary Sill, calling on multiple witnesses, including a number of Albany Police officers who investigated the incident, as well as the victim and a witness.
On the evening of Feb. 21, Gubari encountered two juveniles – ages 14 and 17 – who were residents at the St. Anne Institute walking along Central Avenue.
Gubari, while in his vehicle, engaged the juveniles in conversation and then began following them. After Gubari stopped them again, they got into his vehicle, and he drove them to a dark parking lot off Central Avenue.
After getting in the back seat with the 14-year-old, he engaged in vaginal sexual contact with her using forcible compulsion. The juvenile tried to push him off, but he ignored her pleas and continued his assault.
Gubari was remanded to the custody of the Albany County Correctional Facility after the guilty verdict and faces up to 25 years in state prison when he is sentenced.
