Albany County District Attorney Lee C. Kindlon announced today that a 25-year-old man who is serving a state prison sentence for two stabbings in Troy has been formally charged for causing the death of Daniel Frament, 76.
Albino Zacarias-Garcia was arraigned on sealed indictment in front of the Honorable William Little Monday morning charging him with one count of Murder in the Second Degree.
Frament was found suffering from stab wounds and head trauma on April 18, 2024, along the Mohawk Hudson Bike Hike Trail and later died from his injuries.
A 19-month-long investigation involving the Albany County District Attorney’s Office, the Menands Police Department, New York State Police and Albany Police produced more than 400 leads. NYSP also tested dozens of items at the scene for DNA.
A break in the case came when police got a positive match in the Combined DNA Index System (CODIS) that linked Zacarias-Garcia to a piece of evidence at the scene. The DNA match happened because Zacarias-Garcia was arrested on two separate stabbings in Troy in March of this year and sentenced this past summer to 15 years in state prison.
DA Kindlon praised the unwavering determination of those involved in the long-term investigation and put it in a larger context.
“My office, and by extension my partners in law enforcement, will not rest until we are able to secure justice for victims” DA Kindlon said. “We’re like a dog with a bone – we just don’t let these things go. So I want everybody out there to understand that if an arrest isn’t made right away, we will continue to investigate these things until we can bring justice for victims. So let me make my message clear to those out there who think they can perpetrate violence against my fellow citizens: Your day will come. Reckoning is coming.”
Zacarias-Garcia pleaded not guilty and was returned to the custody of the Department of Corrections and Community Supervision, where he is serving his sentence at Clinton Correctional Facility. He is facing up to 25 years to life on this new charge.
Joseph Brucato, Assistant District Attorney and Bureau Chief of the Major Crimes Unit, is prosecuting the case.
