Albany County District Attorney Lee C. Kindlon announced today that a 29-year-old Rotterdam man has been formally charged for killing a man while driving intoxicated.
Matthew Merriman was arraigned on a three-count indictment Monday in front of the Honorable Roger McDonough that charges him with Aggravated Vehicular Homicide, Manslaughter in the Second Degree and Assault in the Second Degree.
On Sept. 30 at around 5:45 p.m., Albany Police responded to Everett Road near the I-90 exit ramp for reports of a crash. Upon arrival, officers found Matthew Mardon, 34, inside a vehicle suffering from serious injuries. Albany Fire Department and emergency medical personnel worked to stabilize Mardon but he died at the scene.
Merriman, who was treated at Albany Medical Center Hospital for non-life-threatening injuries, was later taken into custody after officers observed signs of impairment. His blood alcohol content was above .18, according to police.
A preliminary investigation revealed that the victim was exiting the off ramp of I-90 onto Everett Road when Merriman’s vehicle, which was traveling northbound on Everett Road, crashed into him.
Merriman pleaded not guilty and was remanded to the custody of the Albany County Correctional Facility.
Bureau Chief of the Vehicular Crimes Unit Collin D’Arcy and Assistant District Attorney Elizabeth Jektyan are prosecuting the case.
