Albany County District Attorney Lee C. Kindlon announced today that a 30-year-old Rotterdam man has admitted to driving while intoxicated when he killed a man last year on Everett Road in Albany.

Matthew Merriman pleaded guilty to Aggravated Vehicular Homicide Wednesday in front of the Honorable Roger McDonough.

On Sept. 30 at around 5:45 p.m., Albany Police responded to Everett Road near the I-90 exit ramp for reports of a crash. Upon arrival, officers found Matthew Mardon, 34, inside a vehicle suffering from serious injuries. Albany Fire Department and emergency medical personnel worked to stabilize Mardon but he died at the scene.

Merriman, who was treated at Albany Medical Center Hospital for non-life-threatening injuries, was later taken into custody after officers observed signs of impairment. His blood alcohol content was above .18, according to Albany Police.

An investigation revealed that the victim was exiting the off ramp of I-90 onto Everett Road when Merriman, who was traveling northbound on Everett Road, ran a red light and crashed into him.

Merriman was remanded to the custody of the Albany County Correctional Facility following his plea and will be sentenced on Aug. 21, when he will face an indeterminate state prison sentence of six and two-thirds to 20 years.

Bureau Chief of the Vehicular Crimes Unit Collin D’Arcy and Assistant District Attorney Elizabeth Jektyan are prosecuting the case.
