Albany County District Attorney Lee C. Kindlon announced today that a 27-year-old Albany man is heading to state prison for a violent attack that injured an Albany police officer.

Emory Johnson was sentenced by the Honorable William Little Tuesday to serve three years in state prison followed by three years of post-release supervision after he pleaded guilty to Assault in the Second Degree and Criminal Mischief in the Second Degree.

On Feb. 7, 2025, Johnson was arrested by Albany Police for an incident at the City Mission where he smashed a computer, monitor, printer and picture frame on the ground. While in custody, Johnson kicked an on-duty uniformed police officer in the chest, causing him to fall backwards and land on his knee. The officer was transported to Albany Medical Center and later underwent surgery for a fractured patella.

Assistant District Attorney Taylor Cupp of the Major Crimes Bureau prosecuted the case.
