Albany County District Attorney Lee C. Kindlon announced today that a 22-year-old man is heading to state prison for having a loaded gun during a traffic stop.

Isiah Cherry was sentenced by the Honorable Andra Ackerman to serve five years in state prison followed by five years of post-release supervision after he pleaded guilty to Criminal Possession of a Weapon in the Second Degree and Attempted Assault in the Second Degree.

New York State Police attempted to detain Cherry on Feb. 5 after he committed traffic violations on Lexington Avenue in Albany. Cherry fought with Troopers during the traffic stop and ultimately threw a handgun and drugs outside of the car.

Troopers later recovered 18 grams of crack cocaine and a Springfield Hellcat 9mm handgun that was loaded and reported stolen out of North Carolina.

On March 27, while being held in Albany County Correctional Facility, Cherry also kicked and injured a fellow inmate. Ackerman sentenced him to one and a half to three years, to run concurrently, on the attempted assault charge.

Assistant District Attorney Marissa Schatzel of the Street Crimes Bureau prosecuted the case.
