Adolescent Tobacco Use Prevention Act (ATUPA)

The Albany County Department of Health (ACDOH) enforces New York State’s Adolescent Tobacco-Use Prevention Act (ATUPA), established under Article 13-F of the New York State Public Health Law.

This law prohibits the sale of tobacco products*, herbal cigarettes, rolling papers, pipes, and more to anyone under the age of 21. Amendments to ATUPA have expanded these restrictions to include shisha, smoking paraphernalia (e.g., hookahs and water pipes), electronic cigarettes, and liquid nicotine.

*Tobacco products include, but are not limited to cigarettes, cigars, bidis, chewing tobacco, and powdered tobacco.
