Making Albany Homes Lead-safe

The New York State Rental Registry and Proactive Lead Hazard Inspections law helps protect families from lead exposure in rental housing, focusing on the communities that are most at risk—including several neighborhoods right here in Albany. [PHL Art.13, Title 10, §1377]

What properties are affected?

If you own a residential rental property with two or more units in the following City of Albany ZIP codes: 12202, 12206, 12208, 12209, 12210; and the property was built before 1980, you are required to register with the New York State Rental Registry by January 2, 2026.

Registration is not transferable. New owners must update the registry within 30 days of property transfer.

What does the law require?

The law requires a lead inspection every three years for each rental unit. Each inspection will include:

  • Visual check for deteriorated paint and bare soil;
  • Dust wipe sampling to detect invisible lead dust.

Pre-1980 rental housing must be inspected and documented as free of lead hazards before receiving a lead-safe certificate.

Hire certified contractors

If you're planning work on a home built before 1978, it's critical to hire certified professionals. There are two types of certified contractors:

  • EPA-Certified RRP Contractors
    For renovation, repair, and painting projects that disturb lead-based paint.
  • EPA-Certified Lead Abatement Contractors
    For permanently eliminating lead hazards by removing, replacing, or enclosing components coated with lead-based paint.
