If you are declared the successful bidder or backup bidder, you will be required to execute a contract of sale for the bid amount and submit a non-refundable deposit.

• The required deposit is either $100 or 20% of the bid amount, whichever is greater, in addition to a buyer’s premium.
• If payment is made using cash or guaranteed funds, the standard buyer's premium is discounted by 2.77% to 6%.
• The standard buyer’s premium is 8.77% for all other forms of payment.

Accepted forms of payment for the deposit include:

• Cash;
• Bank check;
• Certified check;
• VISA, MasterCard, or Discover (see note below about credit card payment).

Please note:

• Credit card deposits can only be made through the auction vendor.
• Albany County accepts certified checks, bank checks, or cash for in-person deposits only.
• Personal checks, business checks, and American Express are not accepted.
• Both the deposit and the buyer’s premium are non-refundable.

Failure to submit the required deposit, or submission of a payment that is returned due to insufficient funds, will result in disqualification and the bid being rendered null and void.

Additional Payment Guidelines:

• If you win multiple bids, any cumulative amount exceeding $10,000 from a single bidder must be paid using certified funds.
• The County cannot accept cash payments exceeding $10,000.

Payment Terms

Successful bidder deposits must be received within 5 business days.

• Deposits paid directly to the County must be in certified funds or cash.
• Federal law prohibits receipt of cash in excess of $10,000.00. 
• Certified funds or bank checks should be made payable to:

Deposits can be made in person in Room 117 at 112 State Street, Albany, NY.

All deposits must be RECEIVED within 5 business days. 

• The County will schedule closings once deeds are ready for delivery.
• A certified mail notice and closing statement will be mailed to your registration address.

Closing is required within 30-days from the date on the notice and closing statement. 

• If the successful bidder does not close, backup bidders will be contacted by certified mail.

IMPORTANT!

• If the approved bidder fails to pay the balance on time, the deposit will be forfeited, and the parcel may be re-sold at a future auction.
• The original bidder may be held liable for any deficiency between the original bid and the resale price, plus any County-incurred costs.
• A bidder who fails to close may be restricted from future auctions and held financially responsible for losses on resale.
• Extensions on closing may be granted at the County’s discretion. If granted, the bidder is responsible for any County costs related to the property from the original closing date.
